LM3 Online provides the LM3 Online web site, including the home page and other content (collectively, the "LM3 Online Site") subject to your compliance with the terms and conditions below.

  1. RULES

You agree to pay all charges incurred by you at the prices in effect when such charges are incurred.   6. RECOURSE
    If you are dissatisfied with the LM3 Online Site or with any terms, conditions, rules, policies, guidelines, or practices of LM3 Online in operating the LM3 Online Site, your sole and exclusive remedy is to discontinue using the LM3 Online Site.
  7. CONFIDENTIAL INFORMATION
    You authorise LM3 Online to collect from any party and to retain all relevant information relating to your use of the LM3 Online Site, and you hereby authorise any party to provide us with such information.   8. INDEMNITY
    You agree to defend, indemnify and hold LM3 Online from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any Violation of this Agreement by you or users of your account, or in connection with the use of the LM3 Online Site or the Internet or the placement or transmission of any message, information, software or other materials on the LM3 Online Site or on the Internet by you or users of your account.
  9. TRADEMARKS
    LM3 Online and other names, logos and icons identifying LM3 Online and LM3 Online products and services referenced herein are trademarks or registered trademarks of LM3 Online. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.
  10. DISCLAIMER
    The software contained in this archive is provided "as is" without warranty of any kind. The entire risk as to the results and the performance of the software is assumed by the user, and in no event will LM3 Online be liable for any consequential, incidental or direct damages suffered in the course of using the software in this archive.
  11. INTELLECTUAL PROPERTY
    You acknowledge that LM3 Online own all right, title and interest in and to the LM3 Online web utility, and software or content provided through or in conjunction with the LM3 Online Site, including without limitation all Intellectual Property Rights. "Intellectual Property Rights" means any and all patent rights, copyright, trade secrets, trade and service marks, design rights, rights in or relating to databases, rights in or relating to confidential information and any other intellectual property rights throughout the world, whether registered or unregistered and including applications for any such rights.

    You agree not to (and agree not to allow third parties to) remove, obscure, or alter LM3 Online’s copyright notice, trade marks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through LM3 Online.
  12. MISCELLANEOUS
    This Agreement, including any and all documents referenced herein, constitute the entire agreement between LM3 Online and you pertaining to the subject matter hereof. LM3 Online's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement be determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein.
